The website “www.thelodgehotel.pt” (hereinafter “Website”) is an integral part of the Website, therefore additional information on this Website may be obtained by reading its Legal Notice.

The Website “www.thelodgehotel.pt” is registered in accordance with the “Regras de Registo de PT” under legal deposit no. 376640/14, and is property of RIVERSIDE HOTEL, S.A. (hereinafter “The Lodge Hotel”), with registered office at Rua Serpa Pinto 60, 4000-307, Gaia.

The Lodge Hotel is managed by RIVERSIDE HOTEL, S.A., a public limited company with registered office at Rua Serpa Pinto 60, 4000-307, Gaia, with the Sole Registration and Corporate Taxpayer no. 514 362 529, and the share capital of € 50,000.00 (Fifty thousand Euros).

 

  1. OBJECT AND SCOPE OF THE WEBSITE

These Booking Terms and Conditions apply to the use of the Website by its visitors (hereinafter “Users”) as well as to any transaction of a commercial nature carried out by them through bookings made through the Website or an authorized booking platform.

Any booking made through the Website or an authorized booking platform implies acceptance of the Terms and Conditions of the booking by the User.

The Lodge Hotel reserves the right to change these Booking Terms and Conditions without prior notice, any changes will be posted on “www.thelodgehotel.pt”. Changes to the Booking Terms and Conditions will only apply to bookings made as of their date of publication on www.thelodgehotel.pt. In case of doubt as to the Terms and Conditions applicable to bookings made via the Website or an authorised booking platform, the Terms and Conditions published on www.thelodgehotel.pt shall prevail and The Lodge Hotel therefore recommends that Users consult the Terms and Conditions published on the Website.

 

  1. CONTENT OF THE WEBSITE

 The reproduction, transfer, distribution or storage of the contents of the Website, without prior written authorization from The Lodge Hotel is prohibited for any purpose other than strictly personal use.

The Lodge Hotel reserves the right to change, at any time, the information and eventual commercial offer referring to: prices, promotions, commercial conditions and services, being that these changes will only apply to hotel and restaurant services acquired after their publication on the Website, not affecting any reservations in progress.

Any entity is expressly forbidden to publish hyperlinks and/or links to the Website, regardless of the intended purpose, without prior authorisation from The Lodge Hotel. The use of the domain of the Website for abusive purposes, without prior authorization, will result in The Lodge Hotel resorting to the appropriate legal means. If you find hyperlinks on other Websites which allow you to access the Website, we inform you that The Lodge Hotel is not responsible for the origin of the page in question or its content.

The Lodge Hotel expressly rejects any responsibility for advertisements and publicity campaigns using the Lodge Hotel brand, unless they are carried out by entities duly authorized to do so.

The Lodge Hotel conducts its business with Users by giving priority to contacting them through the institutional channels specially created for this purpose and duly disclosed on the Website.

If the User suspects the fraudulent nature of any interaction using the name of RIVERSIDE HOTEL, S.A., or of the brand The Lodge Hotel, under no circumstances should the recipient of this action access, confirm or provide personal data, including bank details, nor subscribe to any service offered. The Lodge Hotel recommends that you do not click on the associated links and that you do not access any external website. If you have any doubt about the accuracy of any communication which refers to the names RIVERSIDE HOTEL, S.A., or The Lodge Hotel brand, you must contact us through the contacts available on the Website.

In order to protect its interests, The Lodge Hotel will take all necessary and appropriate measures against any abuse of its industrial property rights (including, but not limited to, its logo and company name), good name and reputation.

In the event that the price displayed on the Website is different from the real price, the User will be contacted by The Lodge Hotel in order to confirm whether they wish to keep their reservation with the necessary adaptations.

Although every effort is made to prevent this from happening, an error may occur in the Website code which results in the values of the hotel and restaurant services shown not corresponding to the real value. In these cases, The Lodge Hotel will take the necessary and appropriate measures to correct the price and duly communicate it to the User, namely by telephone contact.

All contractual information is written in Portuguese and English, as well as the information on the articles, email notifications and booking formalities, without prejudice to the fact that the same information may be presented in other languages.

 

  1. INTELECTUAL PROPERTY

The term intellectual property is used in these Terms and Conditions to cover the concepts of ownership of copyright and related rights and industrial property.

The content of the texts, comments, works, illustrations, pieces of work and images reproduced or represented on the Website are duly protected by the respective copyrights. Thus, their use will only be authorized for private purposes, without prejudice to more restrictive provisions, all in accordance with the Código do Direito de Autor e dos Direitos Conexos. The Lodge Hotel is not liable for losses arising from any interference, interruptions, computer viruses, malfunctions or disconnections of the operating system or any other computer failure resulting from an event of major force that may temporarily prevent Users from accessing, browsing or booking hotel and restaurant services.

The Lodge Hotel is not liable for fortuitous or major force situations resulting from unforeseen events or natural forces beyond human control that cannot be avoided or situations that make it impossible to fulfill the service that cannot be reasonably imputed or attributable to The Lodge Hotel, namely natural disasters, terrorist attacks, war, epidemics, among others. Whenever this occurs, The Lodge Hotel will take the appropriate and necessary measures to inform Users immediately and as soon as it becomes aware of this, of the circumstances and foreseeable consequences of this impossibility.

 

  1. USERS’ OBLIGATIONS

Users undertake to comply with and respect these Terms and Conditions, namely:

  1. To refrain from introducing, storing or disseminating through the site contents that are defamatory, obscene, injurious, xenophobic and/or of any other nature that violate the general principles of law and public order;
  2. Not to use fake identities;
  3. To provide correct personal data and addresses so that The Lodge Hotel can process them appropriately when necessary;
  4. Users are expressly forbidden to transmit messages or information that is injurious, misleading, defamatory, obscene or that violates, in any way, the rights of third parties, as well as making available any information that may be harmful to third parties, the owner of the Website or the entity that manages it.

The User is responsible for the veracity of the data communicated to The Lodge Hotel, undertaking to communicate any alteration to the same, through the channels provided on the Website or on the authorized booking platforms.

  1. RESERVATIONS

Reservations can be made through the booking platform without the need for the User to register on the Website or authorized booking platforms by completing a form provided for this purpose.

The User must follow all the booking steps, for which screens will be displayed throughout the procedure, entering his/her personal data in the respective form.

The promotional offers that appear on the Website www.thelodgehotel.pt are exclusive to the Website or the authorized booking platforms, and therefore may not coincide with the prices charged at other points of sale. These prices are valid on the day they are advertised and only for reservations made on that day. All reservations are subject to confirmation by The Lodge Hotel, depending on the availability of the hotel and restaurant establishment.

For the reservation request to be duly validated, the User will have to expressly accept the present Terms and Conditions of the reservation, otherwise the services cannot be rendered to the User. The Lodge Hotel keeps a set of data intended to prove the contractual relationship. The Lodge Hotel will keep the electronic documents through which the contract is formalized. These data will be kept for purposes associated with the commercial transactions between the parties.

Upon completion of the booking procedure, an automatic email will be sent to the email address indicated by the User, with the booking details. If you identify an inaccuracy you should request, as soon as possible, its amendment or cancellation of the reservation made.

The payment of the reservation is made in euros (€). The following payment methods shall be accepted:

  • Cash;
  • Bank transfer;
  • Debit cards: ATM, Visa Electron, Maestro;
  • Credit cards: Visa, American Express, Mastercard.

 

  1. PAYMENTS AND FEES

When the User makes the payment for their reservation, the total value of the reservation includes VAT at a reduced rate of 6% of the total value.

The Municipal Tourist Tax will be added to the reservation total value.

 

      12. CHECK-IN AND CHECK-OUT

  1. It is possible for the User to check-in early or check-out late, upon request, subject to availability. The Hotel reserves the right to reject early check-in or late check-out if there is no availability. In terms of transparency, upon arrival at The Lodge Hotel, the User must check-in at the following times:

 

From 15:00 p.m.

The Check-in is free of charge

From 08:00 a.m. to 10:00 a.m.

If there is availability, the amount to be charged for this early check in, will be equivalent to the night before the arrival date.

From 10:00 a.m. to 15:00 p.m.

Subject to availability, Free of charge.

 

  1. When your stay at The Lodge Hotel ends, you must check out at the following times::

 

Until 12:00 p.m.

Free of charge Check-out

From 12:00 p.m. to 14:00 p.m.

Subject to availability, Free of charge.

From 14:00 p.m. to 18:00 p.m.

If there is availability, the amount to be charged for this late check out, will be equivalent to the night before the arrival date.

From 18:00 p.m.

The amount to be charged will be the total amount of the daily fee.

 

  1. RESERVATION WARRANTY

The User must provide a valid credit card to guarantee the reservation, otherwise it will be cancelled.

At the time of confirmation, a pre-authorization is made through the card for the total amount of the first night.

The User makes the payment for the entire stay, as well as the tourist tax, at the time of check-in.

When booking hotel and restaurant services, the rates in effect are charged, which can be consulted at the Hotel, or be requested via the reservations department.

If you have used a different credit card at the time of booking than the one you wish to use to pay for the hotel and restaurant services provided by “The Lodge Hotel”, you must present, at Check-In, the physical credit card and fill out and sign the proper authorization form and present a valid identification document.

The Lodge Hotel reserves the right to refuse any booking that does not meet these requirements.

 

  1. GROUP RESERVATIONS

All reservations with more than 8 rooms are considered a group reservation. In this case it will be necessary to contact The Lodge Hotel directly, which may reserve the right to apply cancellation and payment policies for groups.

 

  1. CANCEL POLICY

The Users who wishes to cancel their reservation should consult the information of the chosen rate to confirm the applicable cancellation policy.

In case of cancellation on the day of arrival or no-show (when a room is not occupied on the contracted arrival date), or early departure (departure before the contracted departure date), the entire reservation will be charged.

The Lodge Hotel recommends that all Users activate travel insurance to cover any unexpected disruption to travel plans.

 

  1. REQUIRED OFFICIAL DOCUMENTS

All guests (adults and children) staying at The Lodge Hotel must present a valid identification document issued by the official authorities of their country of origin.

Minors not accompanied by parents or an adult will not be admitted. As for minors not accompanied by their parents, but by an adult, they must present a suitable declaration, complete, not erased and in perfect state of conservation, written and authenticated in legal terms.

 

  1. CHILD POLICY

The Lodge Hotel offers free of charge, to children under 3 years old, a crib, upon request and subject to availability (available in all room types).

For children aged between 3 and 12 years old (inclusive), a supplement of €50 per night may apply (extra bed subject to availability and only applicable to some types of rooms and suites).

 

  1. CONDITIONED MOBILITY

The Lodge Hotel has a room for people with reduced mobility, which can be made available to the user upon request and subject to availability.

The Lodge Hotel’s facilities are suitable for disabled guests, with elevators and wide doors.

 

  1. PETS

Pets are not allowed in the hotel, with the exception of guide dogs, upon presentation of valid documentation.

 

  1. PARKING AND VALET PARKING SERVICES

Users can leave their cars in the public parking lot near The Lodge Hotel, subject to payment and subject to availability.

he Lodge Hotel offers, subject to availability and service priority, a valet parking service to all Users who come to the hotel in their own or rented car and have parked it in the Saba Beira-rio car park. The valet parking service is available between 7:00 a.m. and 11:30 p.m. To use this service, the user must inform The Lodge Hotel of his arrival 30 minutes in advance. When the User arrives at The Lodge Hotel, it will be met by one of the staff members who will take care of its luggage and park its car.

The parking lot belongs to the “SABAPORTUGAL – PARQUES DE ESTACIONAMENTO, S.A.” group and is a public parking lot, so that the rules of the Highway Code in force apply.

The Hotel does not accept any responsibility for loss or damage to the vehicle, nor for any damage that the vehicle may cause to third parties.

Any complaint should be presented at the reception of the Hotel and / or at the reception of the car park, and any loss, damage or personal accident or damages to the vehicle, should be immediately reported to the competent authorities, with the vehicle immobilized.

 

  1. NO-SMOKING POLICY

The Lodge Hotel has only non-smoking rooms, and the same policy applies to all common areas.

 

  1. EVENTS AND MEETINGS

The Lodge Hotel has several rooms that can be used for corporate or social events, with a capacity of between 80 and 280 people. The rooms are adequately equipped with audio and video equipment.

The Lodge Hotel offers two exclusive rooms in the vicinity of the hotel, should Users wish to hold more intimate events, with maximum capacity for 20 and 30 people, respectively.

The availability of the meeting rooms and events is subject to prior approval by The Lodge Hotel, therefore the User’s request is not equivalent to the confirmation of the reservation.

 

  1. RESTAURANT SERVICES

To guarantee the availability of the restaurant services, the User should make a reservation at Dona Maria Restaurant.

Dona Maria Restaurant has the following opening hours:

Breakfast

From 07:00 a.m. to 10:30 a.m. (every day, including weekends and holidays)

Lunch

From 12:30 p.m. to 15:00 p.m. (from Monday to Friday)  

From 13:00 p.m. to 15:30 p.m. (weekends and holidays)

Dinner

From 19:30 p.m. to 23:00 p.m.

 

Dona Maria Restaurant is subject to a smart casual dress code. Users are not allowed to enter wearing flip-flops, sportswear, beach or hiking clothes.

 

  1. APPLICABLE LAW

All reservations for hotel and restaurant services made through the Website are subject to Portuguese law. In the event of a conflict or divergence in the interpretation of the Terms and Conditions of the reservation, this may be submitted to the competent Portuguese Court.

Regardless of whether or not the User is outside Portuguese territory, The Lodge Hotel clarifies and informs you that any legal action must be taken in the Portuguese courts, with the User renouncing any other.

 

  1. ALTERNATIVE DISPUTE RESOLUTION

In the event of a dispute between a User and a service provider concerning contractual obligations arising from the provision of services, concluded between the established supplier of goods and consumers residing in Portugal and the European Union, the consumer may resort to a Consumer Dispute Resolution Entity, which in the case of the Hotel “The Lodge” are the following:

  2. Centro de Informação e Arbitragem do Porto
